General Sessions

Criminal and Traffic dockets were heard recently by Judge Ryan J. Moore in General Sessions Court. Included in General Sessions decisions:

• Julio Cesar Alamilla Hernandez pled guilty to driving without a license and was assessed a $50 fine, plus court costs. He also pled guilty to open container violation and was assessed a $50 fine. He also pled guilty to a registration violation and was assessed a $10 fine.

• Fortunato Huerta Martin pled guilty to driving on a suspended license third offense and was sentenced to 6 months to serve 6 days in jail, the balance on supervised probation, assessed a $50 fine, plus court costs. He also pled guilty to financial responsibility law violation and was assessed a $10 fine. He also pled guilty to a light law violation and was assessed a $10 fine.

• Erik Alejandro Moreno Pena pled guilty to driving without a license and was assessed a $50 fine, plus court costs.

• Cesar Sandoval pled guilty to criminal contempt for a failure to appear and was sentenced to 10 days in jail. He also pled guilty to driving without a license and was assessed a $50 fine, plus court costs. He also pled guilty to speeding and was assessed a $10 fine.

• Donald Ashburn had a preliminary hearing and the court found probable cause to bind his case to the grand jury. He is charged with DUI first offense, possession of methamphetamine with the intent to deliver, driving while in possession of methamphetamine, simple possession of a schedule VI substance and unlawful drug paraphernalia.

• Kerry Ashburn had a preliminary hearing and the court found probable cause to bind her case to the grand jury. She is charged with possession of methamphetamine, simple possession of a schedule VI substance and unlawful drug paraphernalia.

• Miguel Angel Benitez pled guilty to a violation of probation and was sentenced to 60 days in jail.

• John Jacob Jedi Berggren pled guilty to violation of probation and was sentenced to 11 months and 29 days in jail. He is eligible to be furloughed into an approved in-patient rehabilitation facility after service of 150 days. He also waived his preliminary hearing and bound his new case to the grand jury. He is charged with simple possession of fentanyl and unlawful drug paraphernalia.

• Cherly Ann Collins pled guilty to a violation of probation and was sentenced to 11 months and 29 days in jail.

• Merek Matthew Elkins pled guilty to DUI third offense and was sentenced to 11 months and 29 days to serve 120 days in jail, the balance on supervised probation with the DUI Court, assessed a $1,100 fine, plus court costs, ordered to perform 24 hours of litter pickup, ordered to attend the victim impact panel, successfully complete the DUI education course, undergo an alcohol and drug assessment and follow all recommended treatment, complete aftercare by the DUI Court and loss of driving privileges for 6 years. He also pled guilty to leaving the scene of an accident and was sentenced to 11 months and 29 days on supervised probation and assessed a $500 fine.

• A capias was issued for Ethan Joseph Fleming for a failure to appear. He is charged with driving on a suspended license.

• Floyd Danial Fults pled guilty to driving on a revoked license second or subsequent offense and was sentenced to 6 months to serve 10 days in jail, the balance on supervised probation, assessed a $50 fine, plus court costs.

• Steven Lynn Gilley pled guilty to possession of methamphetamine and was sentenced to 11 months and 29 days to serve 30 days in jail, the balance on supervised probation, assessed a $750 fine, ordered to undergo an alcohol and drug assessment and follow all recommended treatment. He also pled guilty to driving while in possession of methamphetamine and was sentenced to a loss of driving privileges for 5 years and assessed a $250 fine. He also pled guilty to driving on a revoked license and was sentenced to 48 hours in jail and assessed a $50 fine. These sentences run concurrently.

• Cody Higdon waived his preliminary hearing and bound his case to the grand jury. He is charged with introduction of a contraband into a penal institution and simple possession.

• Jesse Brad Hillis pled guilty to driving without a license and was sentenced to 6 months on supervised probation, assessed a $50 fine, plus restitution to the victim and court costs.

• Joshua Holmes pled guilty to possession of methamphetamine and was sentenced to 11 months and 29 days to serve 120 days in jail, the balance on supervised probation, assessed a $750 fine, plus court costs, ordered to undergo an alcohol and drug assessment and follow all recommended treatment. He also pled guilty to evading arrest and was sentenced to 11 months and 29 days on supervised probation. These sentences run consecutively.

• Eliseo Torres Jantes pled guilty to a violation of probation and was sentenced to 30 days in jail.

• Daniel M. McGuire pled guilty to a violation of probation and was sentenced to 90 days in jail. He also pled guilty to driving on a revoked license and was sentenced to 6 months to serve 48 hours in jail, the balance on supervised probation, assessed a $50 fine, plus court costs.

• Travis Lee Moore pled guilty to a violation of probation and was sentenced to 60 days in jail. He also pled guilty to another violation of probation and was sentenced to 60 days in jail. These sentences run consecutively. He also waived his preliminary hearing and bound his new matters to the grand jury. He is charged with possession of methamphetamine with the intent to deliver, possession of a schedule VI drug with the intent to deliver, unlawful drug paraphernalia, financial responsibility law violation and driving on roadways laned for traffic violation.

• Larry R. Pack pleaded guilty to simple possession of a schedule VI substance and was sentenced to 11 months and 29 days on supervised probation, assessed a $250 fine, plus court costs. He also pled guilty to unlawful drug paraphernalia and was sentenced to 11 months and 29 days on supervised probation and assessed a $150 fine. These sentences run concurrently.

• Kadin Wayne Rutledge pled guilty to a violation of probation and was sentenced to 60 days in jail.

• Janel Simpson pled guilty to a violation of probation and was sentenced to 30 days in jail.

• A capias was issued for Alan Dean Smith for a failure to appear. He is charged with unlawful drug paraphernalia and expired registration.

• Triston Bohdi Chase Tate pled guilty to DUI third offense and was sentenced to 11 months and 29 days to serve 120 days in jail, the balance on supervised probation with the DUI Court, assessed a $1,100 fine, plus court costs, ordered to perform 24 hours of litter pickup, ordered to attend the victim impact panel, successfully complete the DUI education course, undergo an alcohol and drug assessment and follow all recommended treatment, complete aftercare by the DUI Court and loss of driving privileges for 6 years.

• Luis Rocha-Villanueva pled guilty to driving on a revoked license and was sentenced to 6 months to serve 48 hours in jail, the balance on supervised probation, assessed a $50 fine, plus court costs.

• Michael Bain pled guilty to unlawful drug paraphernalia and was sentenced to 11 months and 29 days on supervised probation, assessed a $150 fine, plus court costs.

• Ethan Joseph Fleming pled guilty to criminal contempt for a failure to appear and was sentenced to 8 days in jail, assessed a $50 fine, plus court costs.

• Audie J. Floyd pled guilty to simple possession of methamphetamine and was sentenced to 11 months and 29 days to serve 45 days in jail, the balance on supervised probation, assessed a $750 fine, ordered to undergo an alcohol and drug assessment and follow all recommended treatment and assessed court costs. He also pled guilty to unlawful drug paraphernalia and was sentenced to 11 months and 29 days on supervised probation, assessed a $150 fine, plus court costs. He also pled guilty to driving on a revoked license and was sentenced to 6 months and to serve 4 days in jail, the balance on supervised probation, assessed a $50 fine, plus court costs. These sentences run consecutively.

• Libnis Emerson Hernandez pled guilty to evading arrest and was sentenced to 11 months and 29 days on supervised probation.

• Gerald Pritchett pled guilty to a violation of probation and was sentenced to 30 days in jail.

• Kelly Sanders pled guilty to a violation of probation and was sentenced to 30 days in jail.

• Madeira Wannyn pled guilty to criminal contempt for a failure to appear and was sentenced to 5 days in jail, assessed a $50 fine, plus court costs.

• Marco Antonio Valdez Aguilar had a preliminary hearing and the court found probable cause to bind his case to the grand jury. He is charged with domestic assault.

• Dennis Craig Broadway waived his preliminary hearing and bound his case to the grand jury. He is charged with 14 counts of animal cruelty. He also surrendered his right of ownership of the animals that are the subject of these proceedings; he remains in custody. If he were to make bond, he would be prohibited from owning or possessing any animals, during the further pendency of this case.

• Brandy Nicole Keen pled guilty to criminal contempt for a failure to serve her jail time and was sentenced to 10 days in jail, assessed a $50 fine, plus court costs. This is consecutive to any previously imposed sentence. She also pled guilty to a violation of probation and was sentenced to 90 days in jail. She also pled guilty to driving on a revoked license and was sentenced to 6 months to serve 10 days in jail the balance on supervised probation. She also pled guilty to unlawful drug paraphernalia and was sentenced to 11 months and 29 days to serve 20 days in jail, the balance on supervised probation, assessed a $150 fine, plus court costs. These sentences run consecutively.

• Areth Aquino Lopez was admitted into the Second Chance Program and was ordered to successfully complete 12 hours of anger management, maintain lawful behavior and pay court costs. She is charged with domestic assault. This matter will be reviewed in June.

• Oscar Ortiz Miller waived his preliminary hearing and bound his case to the grand jury. He is charged with felony theft of property and violation of an order of protection.
