Trial dates set in murder case

Two people charged for the murder of Dennis Carter in 2019 had their jury trial dates set in Circuit Court Wednesday morning. 

The trials of Timothy Wayne Baer and Kate Elizabeth Prichard will be April 16-18. Baer and Prichard face charges of second-degree murder and aggravated assault. Carter, 51, was shot to death on June 1, 2019 inside Rebels Motorcycle Club at 833 Pike Hill Road. Carter was a military veteran.

When Baer and Prichard appeared in court in 2019, prosecutors painted the scene of a poker game which turned into a bloody brawl that led to the shooting death of Carter. Prosecutors stated the murder victim brought a future prospect to the motorcycle club and the group began to play poker. The prospect reportedly continued to win each hand and Baer became angry and pulled a gun. Carter reportedly intervened and a fight began between him and Baer. 

Autopsy results revealed Carter was shot through the buttocks with a bullet going into his abdominal region hitting a main artery leading him to bleed to death. Carter’s face and head also had severe trauma. During the court appearance in 2019, prosecutors say Carter was found lying unconscious in a pool of his own blood making gurgling noises. EMS began to perform life-saving procedures, but Carter succumbed to his injuries at the hospital. 

Police on the scene claimed they heard Prichard repeatedly say she hoped Carter died, and Baer reportedly offered to pay one of the policemen to kick over Carter’s motorcycle. Prichard also had a large amount of blood on her person, coated on her boots and soaked into her socks. The clothing was sent to the TBI for DNA testing.

Prichard reportedly claimed to have only touched Carter with her boot. However, she was heard saying she wanted to boot stomp Carter, leading to the belief Prichard continuously kicked and stomped Carter in the face causing his extensive head and facial injuries.

Prichard also reportedly yelled, “Kill him, kill him,” during the altercation between Baer and Carter. 

John Cherry, who was also indicted for the murder, reportedly fired two shots in the air in an attempt to stop the fight between Carter and Baer. Prichard allegedly tried to grab the gun and claims her action caused the gun to misfire. 

During the court appearance, the three suspects claimed Carter’s death was caused by a drive-by shooting, but that story quickly collapsed. Baer had wounds to his face, head and hands and claimed he had fallen and was unconscious at the time of the incident. All three suspects could be heard in the background during the 911 call. Prichard could be heard calling out Baer’s nickname “Psycho” and telling him to get up.

Five pistols were discovered at the scene. Two were reportedly found in Cherry’s motorcycle bag and another in his vest. Another gun was found in the kitchen. A 40-caliber gun was discovered in the bathroom garbage can after Prichard reportedly left the bathroom. The same type of gun was allegedly used to shoot Carter. A 40-caliber shell was found by the victim’s body. All of the weapons were sent off for testing. 

The attorneys for the three suspects tried to claim the need for the Stand Your Ground Law in Tennessee, where you can shoot an individual who is physically threatening or assaulting you. However, none of the suspects stated they needed to shoot due to fearing for their lives or being in harm.

Prichard and Baer will both have their jury trial on April 16-18.
